It seemed like a straightforward crime of passion: A husband straying, a wife betrayed, a body found in their bedroom. The wife was accused of the murder, but it was the mistress who called police to the scene. What happened to Adam Kostewicz?

For polish immigrants Grace Pianka and Adam Kostewicz, settling here represented their grasp, at last, of the American dream...
Why is "Polish" written lowercase?
Editor's note: This has been fixed. Thank you, George!
From what was shown on T.V.......I am not convinced 100% that the wife did it. I would be interested in seeing the rest of the evidence that convinced 12 people that she was 100% guilty!
I wondered the same thing. I hope there was evidence not shown to us on this program to convict Grace. From what I saw, they definitely established reasonable doubt.
Yes totally, there is no way that jury could appoint her 100% guilty, there was no hard evidence, the whole sitautaion is not clear, and just from what I have seen, what I have heard, and common sense, Jen is the one that should have been on trial, regardeless of what she said, the Det. should have followed prociedure and checked her before ruling her out as a suspect than have just assumed she wasn't. Now she's missing and won't even tell her son where she's at, that's not the slighest bit odd?? I swear our system is falling apart!!
Because that's how it's suppossed to be written? "The green apple" ...
I was actually convinced that the other lady did it. So I was sort of surprised that she was found guilty?!
Where is the insurance money now?
Jen MacIntyre looks very guilty!!! Her son doesn't fall far from the pathological lying tree!! Not one word that came out of his mouth was believeable but hey- he got his five minutes of fame!! Lose the hat if you want us to take you seriously! It is amazing that a jury convicted Grace on such flimsy evidence. Doesn't say much for the American Judical system. Good luck on your appeal Grace! Oh- send the OIC back to Cadet School- seems he needs to brush up on basics before he is allowed to be a detective!!!!
I totaly agree! What about the fingernail left at the scene and Jen happened to be missing one along with a cut on her trigger hand.
One of the first guilty findings I've seen on your program that I disagree with.Definately reasonable doubt established. Not so-much in the question of intelligence of the jury.Guilty of ignorance and or shaming our justice system. Beyond-areasonable-doubt ? I don't think so. Thanks &sorry, R.C.W.
I agree Jen MacIntyre looks guilty. Blows me away that the jury convicted Grace. No gun, no witnesses and a mistress who has disappeared with her own husband - and the jury didn't think that was suspicious enough to consider? Dishonest people who owe 100's of thousands of dollars. The shell could easily have been planted on Grace prior to the murder. Unbelievably Jen MacIntyre was never investigated, never searched, never checked for gun residue. And what about the possible fingernail? It also seems that Grace was too drunk to do what was done, apparently she could hardly stand. If MacIntyre was innocent she'd make herself available to somebody.
I agree completely that Jen MacIntyre looks guilty, however, I'm about to put a whole in your argument regarding being too drunk. She wasn't "too drunk" to get herself 120 miles away from her home, so truly being drunk isn't a strong enough argument to attest to her innocence.
I do not believe there was enough evidence here to convict the wife. Why would this mistress just not show up, she was a very important witness. If she had nothing to hide she should have been there. The wife Grace could be innocent. I truly believe that Jen, the mistress is guilty. She was just in luck that a rookie detective investigated this case. I truly believe the mistress fired the gun and she was not tested. And the fact that the scene was not scoured for evidence, this case should have been thrown out. I believe that was Jen's fingernail on the floor, even just from the naked eye without a magnifier, it sure looked like it. I believe the wife was so out of it that she did not know what happened that day. I do believe she wasn't a drinker, because who in the heck would drink red wine and chase it with Tequila, OMG, it makes me sick thinking about it. I believe the mistress is guilty. I just cannot believe how she went after his life insurance policy after his death. The wrong woman is in jail. The jury was wrong this time, because there was not enough evidence to convict Grace.
I know. Did they even test Grace's hand for gun shot residue?!
Or if she was in such a hurry to rush out, I dont think she wouldve washed her hands so im sure there couldve been gun residue inside the car or anything she touched like the steering wheel because in the slideshow it said there was no gun residue in or on the purse but just an empty casing
The story was reported in such a way that the wife initially appeared guilty. More details revealed eye-opening information. The assumption, by the juror, that the absence and lack of testimony by the mistress was unimportant is inaccurrate. A very reasonable doubtwas presented.
Strange cat...indeed.
I just finished watching Dateline and was so disturbed by what one of the jurors said near the end of the show that I had to write.
Paraphrasing: The juror stated that when they considered the mistress into the equation it casted doubt so they ignored everything about her and only considered the person on trial.
Wasn't the person on trial cheated out of a fair verdict. If the mistress caused doubt then they could not convict the defendant beyond a resonable doubt.
This really disturbed me. I wonder if your interview with the jurors can be used by the defense in their appeal?
Thank you for listening.
how does a lover get control of a lover's estate??? and no one knows their whereabouts? and it didnt matter in court???
thanks for revealing this (utterly nauseating) story...
the show made it sound as if she had control - actually she just facilitated getting the money to his parents- testomony in court from the insurance company representative said she never could have touched any of the money- but just help set up 3 way calls to Poland so the insurance company could communicate with his parents.
hey infonurse, i think alot of the ill feelings here, is that an entire family is crushed (and drug addict son lossing his parents, no help, no money) ...
and the woman who had a hand in it, is free and is completely absolved from it all... just in the end seems warped, media bent or not
Son is a drug addict? What son? The woman had an affair- should that let the murderer go and put her in jail?
Infidelity is a family crusher neither Adam or Jen should have done it. The price should NOT have been death for Adam or time in jail for Jens part.
Grace's son
what happened to the $800,000 estate that the slut got control of??
It went to his parents - after Jen helped get it to them through the insurance company- the show made it sound as if she got it. Biased reporting- if you kept up with the story during the trial these and other facts were submitted but did not make the papers. It is not so fantastic to say - oh that white speck on the carpet - it was a speck not a fingernail after all.....yes that was part of the real (non-dateline) facts!
Are you a sheep who believes all you see on TV ?
Sounds like infonurse may be the elusive whore Jen.
Infonurse-if you followed both trials you would know the insurance money was frozen by the court after Jen was fired as special administrator. The speck on the carpet that looks like a nail was never impounded therefore never foresically tested. The photo is the only evidence.
As a woman who has never cheated on my husband - i will ignore your name calling post.
The information is from both trials - no need to be Jen to know it only need to know how to read.
Yes, the juror says "The whole aspect of Jen McIntyre being gone was, I guess, the main biggest doubt of the whole case because she wasn't there to explain herself.... But Grace Pianka is on trial here" Wow, so you convict the woman? You are so right, horribly disturbing outcome. Very disturbing jurors (and all 12 of them). Astounding!
what happened gto the $800,000 that the slut got control of??
I worked on a statement that said it all, only to have it 'lost.' Let me summarize:
Reasonable doubt. Give a noodle knock to the jury.
I can't believe the lead detective still has a job. Isnt it basic detective work that the mistress, the one who called 911 would automatically be a suspect? The fact that he never checked one thing about her is absolute negligence.
The answer is NO! You are not automatically a suspect because you just discovered a murder scence. Yeah, Im sure he only interviewed her for the 12 seconds that was shown on Dateline.
I can't believe the lead detective still has a job. Isnt it basic detective work that the mistress, the one who called 911 would automatically be a suspect? The fact that he never checked one thing about her is absolute negligence.
What do you believe? A 6 week trial or a 40 min program?
A 40 minute program that showed hard core evidence of the mistress committing the murder. Jury stated that Jen was not present, and had no choice but to convict the wife. End of discussion. A monkey could have figured that one out. Negligent detective and jury. World is full of idiots! Too bad Grace had to be subjected to it.
Poor Grace? Seriously? Dateline is trying to attract viewers, so why wouldn't they pose this in a light to cast doubt?
If she didn't do it, why doesn't she have her gun, why doesn't she claim it was stolen, why was she running from the house when the FIRE alarm went off - why didn't she take Boris (their dog)? If Adam was alive when she left, why would the alarm continue to go off? If Adam was alive, why would he have not called Jen after Grace left?
As for Cynthia, who suggests to the friends, who have been married for over 20 years... to clean out the bank account because her husband had an affair? Does that sound sane? In addition, why would Grace label an envelope full of cash to Cynthia and Wiktor if she wasn't guilty - if she wasn't trying to kill herself?
Jen should not have run, she is a coward. She should have defended herself and did the right thing for Adam. Shame on her.
The policy should go to Grace (if Grace did not MURDER Adam), now his parents. http://dockets.justia.com/docket/court-azdce/case_no-2:2007cv01705/case_id-356683/
The 40 minute program of course. If the mistress was not guilty why leave? I don't believe that crap about leaving because of death threats.
Who would give them death threats? It isn't like Adam was a star or well known. I think Grace was given the shaft over this.
Where is the money? Why wasn't the mortgage paid? Shouldn't Adam and Grace's son get the money and house?
Jen is the guilty party in this. Her son does not even have the verbal skills to talk decently. If I were a millionaire I most definitely would have paid someone or a slyvan learning center to help my kid speak better english than that.
I really don't think he knows where his parents are. Why wouldn't they tell him where they are?
Did any one speak to Adam's family in Poland? I could not understand how a non-relative (his lover) could gain control over his estate!! In a murder case, why wasn't a lawyer assigned to the estate? Who was the benefactor of the insurance, what about his stepson, was there no will? If there was no will wouldn't the estate automatically go into probate court? Was the jury adviced about the lover conrolling the estate and about the $800,000, if not, why in God's name would a judge not allow the jury to hear this crucial evidence?? Did the judge inform the jury that the trial had to prove beyond a reasonable doubt that the wife was guilty??? I can only assume the jury was full of uneducated idiots and they and the judge have put to shame the entire judicial system, not to mention the unprofessional and inept police department. One comment made earlier by "dcb-1294767" makes a good suggestion and I hope the wife is able to use it in her appeal: the jurer who said they dismissed the information about the lover as the lover wasn't on trial. Again, the jurers totally missed the point that the lovers behavior was EVIDENCE that cast reasonable doubt!!!!! UNBELIEVABLE!
I knew Adam. I worked with him for 3 years. Everything describing Adam is correct. he WAS a great guy. I was over at his house 3 times. I was very good friends with him. I know Grace. I had NO CLUE (not did any of us close to Adam) that he was having an affair. After watching this special, I wasn't aware of the "rookie investigator or the broken fingernail". Now, I'm not certain Grace pulled the trigger. Where is his Jen now?? I thought Grace was jilted, upset, inebriated and killed Adam in a rage because he was leaving her. Now, I'm not so sure.. Her son is lying through his teeth.. He knows where they are..
Curtis,
So sorry for your loss of 2 friends!
A truly disappointing outcome, I am left frustrated and hope that the point raised above about the juror excluding evidence from the verdict is grounds for an appeal. I pray that the innocent shall prevail.
This is a tricky case though. There are still holes in both sides, and I hope Dateline follows up with the appeal. Great defense work!
I can't believe nobody said anything in the court room about Jen knowing where the gun was at in the bedroom. Sounds a little funny don't you think?
The jury did hear that Jen knew that Adam kept a gun in the nightstand draw. It came in though the 1st 911 call.
I feel very disturbed after watching "in the bedroom". Through your program I'm absolutely convinced there's reasonable doubt in this case.
I feel a lot of empathy for Grace about losing her husband and not really knowing what happened that fatal night.
In modern day police investigations it is absolutely crucial that detective(s) follow all leads and examine all physical evidence. Major screw up on their part which eventually lead to false conviction.
I hope Grace and the truth will win. There's only one God we all have to trust. And Jen, ...well, will catch up with"it" sooner or later. Amen
